Terms of Service

By accessing or using WorthLaunching ("the Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

If you do not agree, do not use the Service. These Terms apply to all visitors, registered users, and paying subscribers.

The Service is operated by Yevhenii Spitsyn and Krasotin Mikhail, operating the WorthLaunching service ("we," "us," or "the operators").

WorthLaunching is an Etsy product viability simulator. It helps sellers and aspiring sellers estimate potential profit margins, pricing, cost structures, and product economics for items sold on the Etsy marketplace.

The Service provides simulations and estimates — not guarantees, forecasts, or professional advice of any kind. See the disclaimer above and Section 9 for more detail.

WorthLaunching is not affiliated with, endorsed by, or in any way officially connected to Etsy, Inc.

To use certain features you must create an account. You agree to:

• Provide accurate and current information when registering
• Keep your login credentials confidential and not share your account with others
• Notify us promptly if you suspect unauthorised access to your account
• Be solely responsible for all activity that occurs under your account
• Be of legal age to form a binding contract in your jurisdiction

We reserve the right to terminate accounts that contain false information or that have been inactive for an extended period, with reasonable notice where practical.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to scrape, crawl, or extract data from the Service by automated means
• Interfere with or disrupt the Service, its servers, or its infrastructure
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Impersonate any person or entity, or misrepresent your affiliation with any entity
• Use the Service in a way that could harm, embarrass, or expose other users to risk
• Resell, sublicense, or commercially redistribute the Service without our explicit written permission

Certain features of WorthLaunching require a paid subscription ("Premium"). Subscription details, including pricing and included features, are described on the Pricing page.

• All payments are processed securely by Stripe
• You authorise us to charge your chosen payment method for the subscription fee at the start of each billing period
• Prices are shown inclusive or exclusive of applicable taxes as required — actual tax may vary by jurisdiction
• We may change subscription pricing with reasonable advance notice

Subscriptions renew automatically at the end of each billing period unless you cancel before renewal. You may cancel at any time through your account settings. Access to Premium features continues until the end of the current paid period after cancellation.

Cancellation and Refund Policy: You may cancel your subscription at any time. If you cancel your subscription, you will continue to have access to the paid features of WorthLaunching until the end of your current billing period. After the current billing period ends, your subscription will not renew and your account will be downgraded to the free tier, unless you purchase a new subscription.

Unless otherwise required by applicable law, subscription fees are non-refundable, including for partial billing periods, unused subscription time, unused features, or failure to cancel before renewal.

If you are a consumer located in the European Union, you may have a statutory right to withdraw from an online purchase within 14 days of concluding the contract. Where you request or receive immediate access to the digital service during the withdrawal period, your withdrawal and refund rights may be limited as permitted by applicable law.

WorthLaunching, including its design, code, copy, branding, and simulator logic, is owned by the operators and protected by applicable intellectual property laws.

• You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes
• You may not copy, reproduce, redistribute, sell, or create derivative works from any part of the Service without written permission
• Data and inputs you enter into the simulator remain yours — we do not claim ownership of your inputs

WorthLaunching provides simulations, estimates, and decision-support tools. All outputs are based solely on the inputs you provide and built-in assumptions.

We explicitly do not guarantee:

• Profitability or financial viability of any product
• Revenue, sales volume, conversion rates, or marketplace performance
• Accuracy of estimated fees, shipping costs, or platform policies (which may change)
• That your product will succeed on Etsy or any other marketplace

The Service is not a substitute for professional financial, legal, accounting, or business advice. Decisions made based on WorthLaunching outputs are made at your own risk. We strongly encourage you to validate key assumptions independently before making significant business or financial commitments.

We aim to keep WorthLaunching available and reliable, but we cannot guarantee uninterrupted access to the Service. We may:

• Take the Service offline for maintenance, with reasonable notice where possible
• Modify, update, or remove features at any time
• Discontinue the Service with reasonable advance notice to registered users

We will make reasonable efforts to notify users of significant changes that affect their use of the Service.

To the fullest extent permitted by applicable law, the operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profit, revenue, or data
• Business interruption or failed product launches
• Decisions made based on simulation outputs from the Service

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to the Service shall not exceed the greater of (a) the total fees you paid to us in the two months preceding the event giving rise to the claim, or (b) €50 EUR. Nothing in these Terms limits or excludes liability where such limitation or exclusion is not permitted by applicable law.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such cases, limitations apply to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless the operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or any content you submit through the Service.

Either party may terminate the relationship under these Terms at any time:

• You may close your account at any time through your account settings or by contacting us
• We may suspend or terminate your account for violations of these Terms, fraudulent activity, or non-payment, with or without prior notice depending on severity
• Upon termination, your right to access the Service ceases immediately
• Sections covering intellectual property, liability, indemnification, and governing law survive termination

These Terms are governed by the laws of Hungary, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the Service shall be resolved by the competent courts of Hungary, unless otherwise required by applicable consumer protection laws.

If you are a consumer residing in the European Union, nothing in these Terms limits any mandatory consumer rights or protections that you may have under the laws of your country of residence.

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the Service after any update constitutes your acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify registered users (e.g. by email or an in-app notice) before the change takes effect.
